Terms of Service

These Terms of Service ("Terms") govern access to and use of TripConfirm, a product operated by Digistar, LLC ("Digistar," "we," "us," or "our"). By creating an account or using the service, you agree to these Terms.

1. The service

TripConfirm helps transportation and service businesses create transaction records, collect customer confirmations, send transactional SMS notifications, capture payment evidence, and generate documentation packages. Features may change as we improve the product.

2. Accounts and organizations

• You must provide accurate account information and keep credentials secure.
• You are responsible for activity under your organization, including how your team collects customer phone numbers and obtains consent for transactional SMS.
• You may only use TripConfirm for lawful business purposes related to documenting real customer services.

3. Customer data and SMS

• You represent that you have a lawful basis and required consent to enter customer phone numbers and to authorize transactional SMS about the relevant booking or service (confirmations, verification codes, and receipts).
• Messages are transactional, not marketing. Customers may reply STOP to opt out or HELP for help. Message and data rates may apply. Frequency varies by workflow.
• You must not use the SMS features for spam, phishing, unlawful content, or messages unrelated to the customer's service transaction.

4. Acceptable use

You agree not to:

• Attempt to bypass security, scrape, or disrupt the service.
• Upload malware or knowingly false evidence materials.
• Use the product to harass individuals or violate privacy or telecom laws.
• Resell access except as expressly permitted in writing by Digistar.

5. Intellectual property

Digistar owns TripConfirm software, branding, and related materials. You retain ownership of your organization's content and customer records you submit, and you grant Digistar a limited license to host and process that content solely to provide the service.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGISTAR DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that evidence packages will prevail in any dispute, chargeback, or legal proceeding.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGISTAR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO DIGISTAR FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

8. Indemnification

You will defend and indemnify Digistar against claims arising from your misuse of the service, your customer communications, your content, or your violation of these Terms or applicable law (including SMS consent and telemarketing rules).

9. Suspension and termination

We may suspend or terminate access if you violate these Terms, create risk for the platform or carriers, or fail to pay applicable fees. You may stop using the service at any time.

10. Changes

We may update these Terms by posting a revised version with an updated date. Continued use after changes become effective constitutes acceptance.
